Artificial intelligence (AI) is rapidly moving from experimentation into real-world applications. As AI becomes part of business processes, public services and decision-making, questions around regulation, risk and governance are becoming increasingly important. This is particularly relevant as AI adoption continues to accelerate: according to Eurostat, the share of EU enterprises using AI technologies rose from 13.5% in 2024 to 20% in 2025. But when should these questions be addressed?
Compliance by Design means considering regulatory and risk requirements from the beginning of the AI development process, rather than adding them as a final checklist before deployment.
Decisions made throughout the AI lifecycle can influence the risk profile of a system. The intended use, the data involved, the selected models and services, and the way an application is tested all play a role. Addressing these questions early can help teams better understand potential risks, maintain relevant documentation and make more informed technical and organisational decisions.
From compliance checks to a continuous process
AI systems rarely remain static. Models can change, new data sources can be introduced and applications can evolve from prototypes into operational services. Compliance by Design therefore encourages a more continuous approach: assessing risks, understanding data flows and evaluating AI systems throughout their development and deployment.
This requires legal, technical and operational perspectives to work more closely together. The objective is not to make AI development more complex, but to create a clearer path towards responsible and trustworthy AI.
For Europe’s AI ecosystem, the next challenge is making this approach practical and accessible to the organisations and teams building AI solutions. Under the EU AI Act, the main wave of high-risk system obligations applies from 2 August 2026, with certain obligations phased in as late as 2 August 2027 (according to the AI Act).
